Terms and conditions of use of the New Ducat website
1. General provisions
1.1 These Terms of Use set out the rules for the use of the www.newducat.com website (hereinafter referred to as the
"Service") by Customers and Partners. Membership of the New Ducat (ND) Service is voluntary.
1.2 Your use of the Website constitutes your acceptance of these terms and conditions, the privacy policy and the rules on the processing of personal data in accordance with the applicable legislation.
1.3 The owner of the ND programme is the company FEPIRA Lidia Dejer with registered office in Poznań, 1 Winiarska Street, NIP: 7781028881, REGON: 630419607.
1.4 In matters not covered by these rules, the provisions of the applicable law shall apply.
1.5 These Regulations shall come into force on 1 March 2025.
2 Definitions
ND programme - affiliate and loyalty service offering product and service advertising, affiliation with the possibility of accumulating points and other online and offline privileges for the duration of membership. The programme integrates companies and individual participants on a common platform for the exchange of offers.
ND Code of Values - a set of principles governing cooperation and mutual relations between the Partners. The Code sets out the ethical standards and rules of conduct for the programme, including the principles of fair competition and responsibility.
Partner - an individual or legal entity that has registered for the programme, purchased a points package for a period of one year, accumulates points and enjoys the benefits of the programme. A partner can be a company, an individual entrepreneur or a private person.
Ambassador - A Partner who has earned a minimum of 1,000 points, participated in a dedicated training course and has the opportunity to earn additional income for building community and supporting programme participants. The Ambassador acts as a mentor and helps the other Partners to achieve their business goals.
Virtual Office - an application for Partners with access to programme functions such as the referral system, advertising, Partner databases, point accumulation and other privileges. The Virtual Office allows you to manage advertising campaigns, view transaction history and use additional analytical tools.
ND packages - A collection of shopping points providing the Partner with access to advertising, benefits and privileges for a minimum of one year from registration. These include discounts, access to the advertising platform, offer exchange, gift vouchers, the opportunity to accumulate points and participation in dedicated events.
ND points - units awarded to affiliates for purchases and referrals to the ND programme. The points earned can be exchanged for products, services, discounts or membership renewal. Their value is determined on the Service page.
Membership card - a loyalty card entitling you to discounts and to recommend other Partners. The card contains a QR code for identification in the system. It is the key to enjoying the benefits offered by the ND programme, including access to exclusive promotions.
QR code and reference link - A unique identifier given to the Partner during registration. The QR code and reference link are used to identify the Partner in the system, allow referrals to be tracked and points to be accumulated for the activity of affiliated participants.
Affiliate marketing - a mechanism that allows affiliates to receive benefits for referrals to the programme and purchases made by new participants. The system offers remuneration in the form of ND points or other benefits, which motivates active participation.
ND shop - platform available within the Virtual Office, where all Partners can exchange their accumulated points for products, services, membership renewals or other available benefits. The shop also allows promotional purchases.
Advertising in the ND programme - an effective way to increase visibility and attract new customers. Partners gain access to an advertising platform where they can promote their products and services to an active community. In this way, they build brand recognition, increase sales and strengthen their position in the market.
E-visit - an advertising and promotional tool that enables Partners to present their offer in a digital form. The e-business card contains contact details, a description of services and a QR code leading to detailed information on the ND website or other media.
Business card - discount card - a printed card containing Partner data and a QR code. The business card serves as an advertising and marketing tool and, at the same time, as a discount card, enabling you to obtain discounts or other benefits from other programme Partners once you have registered for the programme.
Gift Voucher - an advertising voucher of a certain value that can be used to purchase products or services under the programme. The voucher can be given to customers or colleagues as a form of reward or gift.
Offer exchange - a section of the Website where Partners can advertise, place ads for products, services, hobbies, skills or cooperation. The Offers Exchange is a place for the exchange of information between Partners and Customers.
Ambassador service - Dedicated form of support to assist with programme operation, affiliation and partner cooperation and advertising, as well as monitoring performance in the programme.
Digital products - offer of online training, e-books, webinars and other educational and functional resources available to Partners as part of the ND programme. The digital products are an element that supports the development of participants' competencies.
ND affiliate system - is a mechanism that allows Partners to actively participate in the development of the programme by recommending it to others. For successful referrals, Partners can receive additional benefits such as extra points, bonuses, discounts or other rewards, according to the rules of the programme. This is a way to build a community of loyal participants and increase the value of New Dukat membership.
Service Administrator - the entity responsible for the management of the ND programme, including the verification of content published on the platform, the resolution of technical problems and communication with programme participants.
Newsletter - periodic e-mails containing information about news, promotions and events within the ND programme. Subscription to the newsletter is available to all registered programme participants.
3 Rules for Membership and Use of the ND Service
3.1 Membership of the Service
3.1.1 Membership of the Service requires registration and the purchase of a Points Package, which implies the payment of a fee for the first year of membership.
3.1.2. A natural person, legal person or an organisational unit which meets the formal requirements specified in these terms and conditions and has fully activated its account may become a Partner of the Website.
3.2 Registration and Account Activation
3.2.1 Activation of a Partner account requires the provision of correct registration data, including personal or company data, and acceptance of the terms and conditions.
3.2.2 The Partner agrees to abide by the Rules of Procedure and the "ND Code of Values", which regulates the principles of cooperation, fair competition and support of the Partner community.
3.2.3 The Affiliate has the right to resign from membership within 14 days of registration without stating any reason by submitting an electronic declaration to this effect.
3.3 Partner's responsibilities
3.3.1 The Affiliate undertakes to provide truthful data during registration and to keep this data updated in the event of changes.
3.3.2 The Affiliate commits, upon account activation, to use all the functions, benefits and privileges of the programme, including access to the virtual office, the Referral System and cooperation with the Affiliates in accordance with the principles of fair competition and support of the Affiliate community.
3.3.3 The Affiliate undertakes not to take actions which damage the image of the Website or other Affiliates.
3.4 Suspension and cancellation of the Account
3.4.1 Membership of the Service may be suspended in the event of a breach of the rules, failure to fulfil membership obligations or provision of false registration data.
3.4.2 The Website Administrator reserves the right to verify the Partner's activity in order to ensure compliance with the Terms of Use.
3.5 Protection of Personal Data
3.5.1 Membership of the ND programme implies acceptance of the Data Protection Principles and consent to the processing of data to the extent necessary to carry out the functions of the programme.
3.5.2 The Partners undertake to process personal data only in accordance with the RODO and other data protection legislation.
3.6 Prohibition of Spam
3.6.1 Partners shall not send unsolicited commercial messages (so-called spam) in any form, including e-mails, SMS, messages in communication applications or via social media, without the express consent of the recipient.
3.6.2 The transmission of commercial information requires the prior, voluntary consent of the recipient.
All marketing materials must comply with the rules of professional conduct and the image of the Service. Partners are fully responsible for the content and form of messages addressed to recipients.
3.6.4 Violation of the rules regarding the prohibition of spamming may result in disciplinary action by the Service Administrator, including withholding of remuneration, termination of the contract and possible costs resulting from legal sanctions.
3.6.5 The Service Administrator undertakes to organise training and provide information material on legal and ethical marketing communications.
Adherence to the above principles is a prerequisite for maintaining ND cooperation and protecting the good image of all parties.
4 Partner participation conditions
4.1 Registration:
- Registration in the ND programme is open to individuals, legal entities and unincorporated bodies.
- In order to participate in the ND programme, it is necessary to register on the website, fill in the registration form and accept these terms and conditions.
4.2 Acceptance of the Rules of Procedure and Code of Conduct:
- Participation in the programme implies acceptance of all provisions contained in the programme regulations and the rules set out in the Code of Conduct.
- The Affiliate agrees to comply with the rules set out in the Rules and the ND Code. Failure to comply with the rules may lead to suspension or removal from the programme.
4.3 Redeeming the ND Points Package:
- The purchase of an ND Points Package is a condition for becoming a Partner and for accessing programme features.
- Participants in the programme are required to select and purchase the Points Package that suits them, which provides access to all the features and privileges offered under the ND programme.
4.4 Receipt of Reference Code:
- Once the Points Package is redeemed, the participant receives a unique reference code that can be used to identify themselves in the programme, earn commissions and promote the ND programme.
4.5 Use of Programme Privileges:
- The participant is entitled to use all the privileges and functions offered by the ND programme in accordance with the acquired Points Package.
4.6 Cancellation of participation:
- Cancellation of participation in the programme can take place within 14 days of registration. In this case, the Affiliate is obliged to submit a written declaration electronically at www.newducat.com.
4.7 Failure to comply with the Rules:
- Failure to comply with the terms and conditions will result in the Partner being able to be removed from the programme after twice being warned by email or post.
- Failure to comply with programme rules may lead to suspension or permanent removal from the programme.
4.8 Programme Activity and Promotion:
- Programme participants can be encouraged to actively participate and promote the ND programme, which can be rewarded with additional benefits or bonus points.
4.9 Consent to the Processing of Personal Data:
- Participants in the programme must consent to the processing of their personal data in accordance with the ND programme's data protection rules and the law.
4.10. Participation in promotions and competitions:
- Participation in promotions and competitions organised as part of the programme is voluntary and does not require additional fees, unless otherwise stated in the rules of the event.
Participation in the ND programme entails acceptance of all terms and conditions and the rules set out in the regulations. Through the ND programme, participants can benefit from a wide range of privileges and advantages that help build customer relationships and grow the business.
5. status and benefits for the partner in the ND programme
Upon registering with the ND Programme and selecting an individual Points Package valid for one year, both customers and companies are automatically granted Partner status. This status opens up access to a range of exclusive benefits and opportunities that allow the programme to realise its full potential.
5.1 Access to Own Virtual Office:
- The affiliate is given access to a personalised control panel, where they can manage their account, monitor their activities and make use of the programme's various features.
- Partners have priority in using all the features of the site, such as advertising, a bid exchange, promotions, gift vouchers, education and other benefits.
5.2 Advertising on the E-Visitor:
- The partner has the opportunity to promote its business by placing an advertisement on the electronic business card, which increases the visibility of its company among customers.
- The E-Visit contains contact details and a QR code for quick redirection to detailed information about the Partner.
5.3 Advertising on Business Cards:
- A partner can advertise their company on the business cards, which act as a promotional tool and enable them to build relationships with customers and business partners.
5.4 Payment Card:
- The affiliate is issued with a payment card, which enables payments to be made and additional programme features such as bonus points to be collected.
- The payment card can also perform an identification function in the programme.
5.5 Access to the Bid Exchange:
- The affiliate has the possibility of using an offer exchange, where it can advertise and display offers, advertisements, products and services and establish business contacts with other programme participants.
5.6 Ambassador's assistance:
- Each Partner can count on the support of a dedicated Ambassador, who helps to use the programme, gives advice and supports in solving any problems that may arise.
- The Ambassador actively supports the Partner in promoting and developing its activities within the programme.
5.7 Gift Vouchers:
- The partner has the opportunity to use gift vouchers that can be used as gifts for customers, employees or colleagues, building loyalty and positive relationships.
5.8 Digital products, Education, Competitions, Events, Promotions:
- Partners have access to various forms of digital products, education such as training, AI implementation, webinars and courses that support personal and professional development.
- Organised competitions and events give Partners the opportunity to win attractive prizes and promote their activities.
- Exclusive promotions and events are only available to Programme Partners.
5.9 Certificate of Accession:
- The partner receives an e-certificate for joining the programme, which confirms their acceptance of our values, their participation and their commitment to the ND programme.
5.10. Access to Affiliates:
- The affiliate has access to an affiliate system that allows them to recommend the ND programme to other individuals and companies.
This allows the Partner to gain new programme participants and receive additional benefits for their activity, including the purchase of advertising, products or services available through the programme.
- Partners have access to exclusive benefits, discounts and promotions that are not available to users without Partner status.
6 Terms and Conditions for the Execution and Issue of Advertisements
6.1 Acceptance of the Advertising Terms and Conditions:
- Participants in the ND programme must accept the terms and conditions for the delivery and broadcast of advertising as set by the programme administrator.
- Entering the advertisements implies full acceptance of the rules and regulations set out in the programme.
6.2 Compliance with the Regulations and the Law:
- Advertisements must comply with the programme rules and regulations and applicable national and international laws.
- Content which infringes copyright, data protection regulations or promotes illegal activities is not permitted.
6.3 Compliance with Ethical Standards:
- Advertisements must adhere to ethical standards and must not contain content that is offensive, discriminatory, vulgar, contrary to morality or that promotes illegal activities.
- Advertisements that are misleading or likely to have a detrimental effect on the audience are unacceptable.
6.4 Alignment with the Target Group:
- Adverts should be appropriately tailored to the target group and must not be harmful or inappropriately targeted.
- Advertising content must be created taking into account the specific nature of the audience, their needs and interests.
6.5 Transparency and Signage of Advertisements:
- Advertisements of a commercial nature must be clearly labelled as advertising to avoid misinformation or confusion for users.
- Signage should be visible and unambiguous to the public.
6.6 Compliance with the Privacy Policy:
- Ads must adhere to the ND programme's privacy policy and any personal data of users used in ads must comply with data protection legislation.
- Any use of personal data for advertising purposes requires your express consent.
6.7 Quality Control and Verification:
- The ND programme administrator reserves the right to verify and control the content of advertisements for compliance with the rules and regulations and programme quality standards.
- Adverts that do not meet the requirements may be rejected or require correction before publication.
6.8 Differentiation of Advertising Forms:
- The ND programme offers various forms of advertising, such as text, graphic and video ads, banners, as well as e-cards.
- Advertisers can choose the forms most appropriate to their needs and marketing objectives.
6.9 Settlement and Payments:
- The terms of billing for advertising and payment of advertisers are determined according to a separate price list by the ND programme administrator.
- All payments must be made in accordance with the accepted rules and deadlines set out in the advertising contract.
6.10 Copyright:
- Advertisements must respect copyright and intellectual property rights. Content used in advertisements must be legally owned or licensed.
- The advertiser is fully responsible for the compliance of its content with intellectual property laws.
6.11. Changes and Updates:
- The ND Programme Administrator reserves the right to change the terms and conditions for the execution and broadcast of advertisements at any time. Advertisers will be informed of any changes well in advance.
6.12. Final Provisions:
- Access to the realisation and broadcast of advertisements in the ND programme is subject to acceptance of certain conditions and compliance with applicable regulations and ethical standards.
- Advertisements can be an effective promotional tool, but their broadcasting must be properly controlled and adapted to the needs and expectations of users.
These conditions are designed to ensure that all advertising content is in line with ND programme values and legislation, while meeting the expectations of advertisers and audiences.
7 Conditions for complaints
7.1 Making a complaint:
- Partners and Customers may submit complaints regarding the operation of the Service or the performance of the services via the contact form available on the ND programme website or by e-mail to the address indicated by the Administrator.
- Complaints should include a detailed description of the problem, the date on which it occurred and the contact details of the complainant.
7.2 Complaint handling procedure:
- Any complaint will be dealt with within 14 working days of receipt, subject to a further 7 working days if additional information is required.
- The administrator will acknowledge the acceptance of the complaint within 3 working days of its notification.
7.3 Problem solving:
- The administrator undertakes to take measures to quickly and effectively rectify the problems reported in the complaint.
- If the complaint is found to be valid, the Administrator will take appropriate remedial steps, including possible refunds or other compensation, if warranted.
8 Terms of cancellation:
8.1 Cancellation of participation:
- The Affiliate may cancel its participation in the programme at any time by submitting a written statement in electronic form to the address indicated by the Administrator.
- The cancellation statement should include your name, surname, the e-mail address registered in the programme and a clear statement of your wish to cancel your participation.
8.2 Reimbursement of fees:
- In the event of cancellation after the guarantee period of 14 days after registration, the Points Package fees paid are non-refundable.
- If cancellation takes place within 14 days of registration, fees will be refunded in full, provided that programme privileges have not been used.
8.3 Deactivation of account:
- Upon resignation, the Partner's account will be deactivated within 7 working days and accumulated points and other unused privileges will be lost.
- Resignation does not affect transactions already concluded between Partners within the programme.
9 Final provisions
9.1 Amendments to the Rules:
- The Administrator reserves the right to amend these Terms and Conditions at any time. Information about the changes will be communicated to Partners by e-mail at least 14 days before they come into force.
9.2 Acceptance of changes:
- Continued use of the Service after the changes have been implemented implies acceptance of the new regulations. Affiliates who do not accept the changes have the right to cancel their participation before the effective date of the changes.
9.3 Dispute resolution:
- Any disputes related to participation in the programme will be settled by the court having jurisdiction over the Administrator's registered office, in accordance with Polish law.
9.4 Contact:

9.5 Applicability of the Rules:
- The Terms and Conditions shall enter into force on the date of their publication on the Website. The version of the Terms and Conditions in force at the time of conclusion of the agreement with the Partner shall apply for the entire duration of the agreement, unless changes are accepted by the Partner.
